5A.1 Notwithstanding anything written elsewhere in this Act, the service system operated and managed by the institute in accordance with this act, any organization or organization with at least eighty percent shares of the Government of Nepal and local bodies. If the institute wants to operate under a contract with a non-profit organization or a consumer organization, the institute may give the service system owned by the institute and related structures, equipment and other related assets to such organization after taking the prior approval of the Government of Nepal. 5a.2. According to sub-section 5A1, the structure, equipment and assets owned or under the control of the organization that can be used by the contracting organization, the duration of the contract, the remuneration that the contracting parties will receive for the contract and other related matters shall be as mentioned in the contract. 5a.3. According to sub-section 5A1, any structure, equipment and property used by the contracting organization owned or under the control of the company shall be returned to the company in accordance with the conditions specified in the contract after the contract period expires. 5a.4. According to sub-section 5A1, the arrangement given to work by contract shall not be deemed to be privatized according to the Privatization Act, 2050.
